1. Agreement
These Terms of Service govern your use of fusefunders.com and any application, form, or tool we make available (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
If you are using the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.
2. What We Do — and What We Do Not Do
Fuse Funders LLC is a broker. We are not a lender and we are not a direct funder.
We collect funding applications from business owners and submit them to third-party funding partners. Those partners — not Fuse Funders — decide whether to extend financing, on what terms, and at what cost. We do not make funding decisions, we do not set rates, and we do not advance funds.
Any estimate, range, or prequalification figure we display is an illustration based on the information you provide. It is not an offer, a commitment, or an approval. Actual amounts and terms come from a funding partner after that partner reviews your bank statements and other documentation, and may differ substantially from any figure shown.
We do not guarantee that you will receive any offer, or that any offer you receive will be on terms acceptable to you.
3. How We Are Paid
Fuse Funders is typically compensated by the funding partner when a transaction closes, not by you. There is no cost to you to apply, and no obligation to accept any offer.
We select funding partners based on which are most likely to fund your business on workable terms, given your revenue, time in business, industry, and existing obligations.
You are responsible for reviewing the terms of any offer you receive directly with the funding partner making it, including the total cost of capital, payment amount, payment frequency, and term.
4. Eligibility
To use the Services you must be at least 18 years old, a legal owner or authorized officer of the business named in your application, and located in the United States.
5. Your Responsibilities
You agree to provide information that is accurate, current, and complete, and to update it if it changes. You are responsible for the accuracy of everything you submit, including documents you upload on behalf of your business.
Submitting false, altered, or fraudulent information — including falsified bank statements or identification documents — is grounds for immediate termination of the Services and may be reported to funding partners, industry databases, and law enforcement.
You agree not to use the Services to submit applications on behalf of a business you are not authorized to represent, to interfere with or disrupt the Services, or to attempt to gain unauthorized access to our systems or another applicant's information.
6. Authorization to Submit Your Application
When you sign our application, you authorize Fuse Funders and its representatives, successors, assigns, and designees to obtain consumer, personal, business, and investigative reports about you and your business, including bank statements and credit card processing statements, from consumer reporting agencies and from banks, creditors, and other third parties.
You also authorize us to transmit your application and any information obtained in connection with it to one or more funding partners for the purpose of evaluating your request.
The complete authorization language is presented to you on the signature page of the application. That language, as displayed at the time you signed, governs.
7. Electronic Signatures and Communications
By completing our application, you consent to conduct business electronically and to receive disclosures, notices, and agreements in electronic form.
You agree that typing your name in the signature field of our application constitutes your electronic signature, and that it is legally binding and enforceable to the same extent as a handwritten signature under the federal ESIGN Act and applicable state law. We record the date, time, and IP address associated with each signature.
You may withdraw consent to electronic communications by contacting us, though doing so may prevent you from using the Services.
8. Text Messages
If you separately opt in, you consent to receive text messages from Fuse Funders, including automated messages, relating to customer care, your account or application, and promotional or marketing offers. Message frequency may vary. Message and data rates may apply.
Reply STOP to any message to opt out. Reply HELP for help, or contact us at funding@fusefunders.com.
Consent to receive text messages is not a condition of applying for or receiving funding.
9. Privacy
Our Privacy Policy explains what information we collect, how we use it, and who we share it with. It forms part of these Terms.
10. Third-Party Funding Partners
Funding partners are independent third parties. We do not control them, and we are not responsible for their decisions, their offers, their conduct, their fees, or their handling of your information. Any agreement you enter into with a funding partner is between you and that partner. Read it before you sign it.
11. Intellectual Property
The Services, including their content, design, and software, are owned by Fuse Funders or our licensors and are protected by intellectual property law. You may not copy, modify, distribute, or create derivative works from any part of the Services without our written permission.
12. Disclaimers
The Services are provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We will give you our honest read on your options, including when we think financing is not the right move. That is our opinion, not professional advice — we are not your attorney, accountant, or financial advisor, and nothing we say substitutes for guidance from your own. Financing is a significant commitment, and we encourage you to review any offer with your advisors before you sign.
We do not warrant that the Services will be uninterrupted, error-free, or secure.
13. Limitation of Liability
To the fullest extent permitted by law, Fuse Funders and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities, arising out of or relating to your use of the Services — whether based in contract, tort, or any other theory, and whether or not we were advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the Services will not exceed one hundred dollars ($100).
14. Indemnification
You agree to indemnify and hold harmless Fuse Funders and its officers, members, employees, and agents from any claim, loss, liability, or expense — including reasonable attorneys' fees — arising out of your use of the Services, your breach of these Terms, or any information you submit that proves to be inaccurate or fraudulent.
15. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules.
Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Kings County, New York, and you consent to the jurisdiction of those courts.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after a change takes effect means you accept the revised Terms.
17. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and any authorization language you sign, are the entire agreement between you and Fuse Funders regarding the Services.
